Program Name: New England Land Survey SMS Messaging

These SMS Messaging Terms & Conditions (“SMS Terms”) govern participation in SMS/text messaging communications provided by New England Land Survey, Inc. (“New England Land Survey,” “NELS,” “we,” “us,” or “our”). By affirmatively opting in to receive text messages from NELS, you agree to these SMS Terms.

1. SMS Messaging Program

NELS may use SMS/text messaging to communicate with customers, prospective customers, attorneys, lenders, real estate professionals, property owners, and other individuals who interact with our company. Messages may include customer-service and transactional communications concerning:

• Customer inquiries and responses;
• Requests for quotes or estimates;
• Survey projects, including Mortgage Inspection Plans and Full Boundary Surveys;
• Project status and document availability;
• Scheduling, coordination, property access, or appointment reminders;
• Billing or payment-related matters; and
• Other information reasonably related to your relationship or communications with NELS.

2. Consent to Receive Text Messages

By affirmatively opting in to SMS communications, you authorize NELS to send text messages to the mobile telephone number you provide. Messages may be sent through our website, telephone system, customer communication software, or messaging technology operated by NELS or its authorized service providers.

Consent is not a condition of purchasing any product or service. Providing a telephone number by itself does not constitute consent to receive recurring SMS messages unless the applicable form or interaction clearly requests and records such consent. Where an SMS opt-in checkbox is used, it should be optional and not pre-selected.

3. Message Frequency

Message frequency varies based on your communications with NELS, the services you request, and the status of your inquiry or project. You may receive recurring messages while a project, quote, scheduling matter, or customer-service issue is active. We do not guarantee a specific number of messages per week or month.

4. Message and Data Rates

Message and data rates may apply. Your wireless carrier may charge for text messages or data usage according to your wireless plan. NELS is not responsible for charges imposed by your carrier.

5. How to Opt Out

Reply STOP to opt out.

You may stop receiving SMS messages at any time by replying STOP to a message from NELS. You may also contact us at (508) 987-0025 or info@nelandsurvey.net and request that SMS communications be discontinued. After an opt-out request, we may send a single confirmation message acknowledging that you have been unsubscribed. You may later re-enroll by affirmatively opting in again through an available NELS enrollment method.

7. Mobile Number Ownership

By opting in, you represent that you are the authorized user of the mobile telephone number provided or have permission from the subscriber/account holder to provide the number and authorize SMS communications. Do not knowingly provide another person’s mobile number without authorization. If you believe your number was enrolled without authorization, contact us promptly.

8. Privacy and Mobile Information

Your privacy is important to us. Our collection and use of personal information, including information associated with SMS communications, is described in our Privacy Policy.

SMS privacy commitment. We do not sell or share your SMS opt-in data, mobile telephone number, or SMS consent information with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers acting on our behalf as necessary to provide the messaging service, or as required by law.

9. Delivery, Carrier Availability, and Liability

SMS messages are transmitted through wireless networks and third-party telecommunications providers. Delivery may be delayed or prevented by carrier coverage, network congestion, device settings, spam filtering, technical failures, or other conditions outside our control.

Carriers are not liable for delayed or undelivered messages.

NELS does not guarantee that every message will be delivered successfully, immediately, or without interruption.

10. Prohibited Use

You agree not to use our SMS communication system to interfere with or disrupt our systems, attempt unauthorized access, submit false or misleading information, impersonate another person, or engage in unlawful activity.

11. Changes to the SMS Program or These Terms

We may modify, suspend, or discontinue our SMS messaging program or particular messaging features at any time, subject to applicable law. We may also update these SMS Terms from time to time. The updated version will be posted on our website with a revised “Last Updated” date.

12. Relationship to Other Terms

These SMS Terms apply specifically to SMS/text messaging communications. Other terms governing NELS services, quotes, orders, surveying projects, website use, or other business relationships may apply separately. If another agreement contains a more specific provision governing SMS communications, that more specific provision will control to the extent permitted by applicable law.
